COMMONWEALTH V. ML

LAW ENFORCEMENT AGENCY: PADUCAH POLICE DEPARTMENT

DRIVING: NONE OBSERVED. ML WAS PARKED IN A CREDIT UNION PARKING LOT. VEHICLE WAS NOT RUNNING. KEYS WERE NOT IN THE IGNITION. ML WAS ASLEEP BEHIND THE WHEEL. 

OFFICER'S OBSERVATIONS: "WHEN I WOKE HIM UP HE SEEMED VERY CONFUSED AND TRIED TO PUT THE VEHICLE IN GEAR EVEN THOUGH THE CAR WAS OFF. HE ALSO ATTEMPTED TO START THE CAR. WHEN I ASKED HIM HOW HE GOT TO WHERE HE WAS, HE KEPT REPEATING, "I'M PARKED." HE SAID HE'D BEEN TRYING TO DRIVE HOME FROM A FRIEND'S HOUSE. ADMITTED TO DRINKING AND SAID HE SHOULD HAVE NOT BEEN DRIVING. I COULD SMELL THE ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH AS HE SPOKE AND HE REMAINED SEEMINGLY CONFUSED AND DAZED THROUGHOUT THE DURATION OF OUR EXCHANGE. STRONG ODOR OF ALCOHOL AND SLURRED SPEECH."

PERFORMANCE ON FIELD SOBRIETY TESTS: "COULD NOT DO THE HGN TEST AND REFUSED OTHER TESTS."

CHEMICAL TEST RESULTS: .188 BREATH TESTS. 

CASE OUTCOME: I FILED A MOTION TO SUPPRESS THE BREATH TEST RESULTS BECAUSE THERE WAS NO PROOF OF OPERATION OR CONTROL OF THE MOTOR VEHICLE WITH TWO HOURS OF THE ARREST. THE JUDGE GRANTED THE MOTION AFTER THE ARRESTING OFFICER TESTIFIED. THE PROSECUTOR THEN AMENDED THE CHARGE TO ALCOHOL INTOXICATION TO WHICH ML PLEADED GUILTY. SMALL FINE AND NO LOSS OF LICENSE.
