ARRESTING LAW ENFORCEMENT AGENCY: PADUCAH POLICE DEPARTMENT
OFFICER'S OBSERVATIONS: I observed the above driving East on Park Avenue. While behind him, I observed him cross the fog line twice. He turned right on to Joe Clifton drive, crossed the fog line again and nearly struck the curb. He had to swerve quickly to avoid striking it. Upon speaking with him, I detected glassy, bloodshot eyes, slow speech and the smell of alcohol. He stated his truck's steering is out of alignment and that was the reason for crossing the line. He admitted to having two beers prior to driving. He showed signs of impairment during pre-exit testing. I conducted the following tests: HORIZONTAL GAZE NYSTAGMUS - four clues; WALK AND TURN - could not hold start position, started walking before instructed, missed heal to toe, stepped off line, stopped while walking and improper turn. He did not verbally refuse, but also did not perform ONE LEG STAND. PBT indicated the presence ofalcohol. Implied consent read. Lawyer contacted. BREATH ALCOHOL - .093. Own blood test refused.
CASE RESULT: I OBTAINED A FIELD SOBRIETY TEST EXPERT, WHO DETAILED THE OFFICER'S ERRORS WHILE CONDUCTING FIELD SOBRIETY TESTING. I OBTAINED A BREATH TEST EXPERT WHO VIEWED THE CALIBRATION AND MAINTENANCE RECORDS OF THE BREATH TESTING MACHINE AND CONCLUDED IT WAS NOT PROVIDING SCIENTIFICALLY ACCURATE RESULTS. I SHARED THIS INFORMATION TO THE PROSECUTOR WHO AGREED TO AMEND THE DUI CHARGE TO A NON-DUI DISPOSITION WITH NO LOSS OF LICENSE.
